Terms and agreement checkbox (B2B) checked by default?

When terms and agreement checkbox is enabled in Sana admin, for a B2B customer this is checked by default on the order overview page. Shouldn't this be not be checked (as is the case for B2C customers), also in the light of the new GDPR regulation?

        Does GDPR include T&C in the regulation? Most T&C relate to performance of the contract rather than details of processing, storage and sharing of data. There is an argument that a separate checkbox for "I have read and agree to the Privacy Policy" or "I consent to processing of my data in accordance with the Privacy Policy" is required under the GDPR, though.
